Aviation Law

There are some areas of aviation law that overlaps with the rules and regulations that apply to maritime law. Because air travel falls into international territory the main time that aviation law becomes application is when an airline company becomes liable for the death or injury or passengers, or when a business losses or damages another company's cargo. Depending on the location of the event, aviation lawyers can choose to have their cases heard in a federal or state level court. The Federal Aviation Administration is a federal agency that regulates air traffic control, handling the licensing of commercial and private aircraft pilots, conducts investigations and regulates the inspection of aircrafts and airports.

All pilots must be licensed by the FAA before they are allowed to fly aircrafts by themselves or be hired by an airline. Pilots that have been accused of any type of misconduct such as using a commercially licensed airplane for private use, flying an aircraft while intoxicated or falsifying records will be investigated and disciplined by the Federal Aviation Administration. This agency also issues official statements following catastrophic crashes which indicate if either pilot error, airline safety failure or an unforeseen act of nature was the cause.

Both commercial aircrafts and private airplanes must be inspected and licensed by the FAA on a regular basis. The FAA will look for mechanical problems, evaluate flight logs and check the licenses of pilots that operate these aircrafts. The Federal Aviation Administration also closely monitors air traffic hubs and awards both individuals as well as air traffic centers that have acted responsibly and helped to prevent crashes.

Although space law falls within aviation law, there are no current rules or regulations on the books. NASA, the National Aeronautics and Space Administration works closely with the Federal Aviation Administration during the course of launches and when scheduling a return flight. In the late 1970s the Federal Aviation Administration was authorized by Congress to initiate a program that would lessen the effects of noise pollution by urging residential homeowners to relocate. Some of these homeowners were compensated for the inconvenience, but now all US airports are able to operate without fear of negatively impacting residential neighborhoods. The Federal Aviation Administration has been working with the Department of Homeland Security in an effort to prevent future acts of terrorism involving aircrafts. As such, both agencies have taken additional security measures and have imposed more restrictions on air traffic control.
